Terms of Use
Last updated: 11 August 2026These terms apply to everyone who uses this website and to residents who use the estate portal. By using either, you agree to them. They are written in plain English on purpose.
1. About this site
This is the official website and resident portal of Ukutula Eco Estate, operated by Ukutula Body Corporate, registration number 2010/000228/07, of Ukutula Road, Orkney, 2620, North West.
The public part of the site tells people about the estate. The portal behind the sign-in page is a private service for residents.
2. Getting access to the portal
The portal is by invitation only. There is no public sign-up. An estate administrator creates your account and emails you a link to set your own password.
Your sign-in details are personal to you. Please:
- Keep your password to yourself and do not share your account with anyone, including other members of your household who should have their own account.
- Choose a password you do not use anywhere else.
- Tell the estate office as soon as you think someone else may have got into your account.
You are responsible for what happens under your account while it is in your control.
3. Acceptable use
When you use this site you agree not to:
- Use it for anything unlawful, or in a way that breaks South African law.
- Attempt to gain unauthorised access to any part of the site, to anyone else's account, or to any system behind it.
- Interfere with the service or try to disrupt it, including attempting to overload it, probe it for weaknesses, or work around its security.
- Use automated tools to harvest content or personal information from the site.
- Upload or send anything harmful, such as malicious code.
4. Estate content on the portal
Notices, events, documents, minutes and contact details on the portal are estate communication, published for the residents of Ukutula Eco Estate.
They are shared with you for your own use as a resident. Please do not republish them, forward them publicly, or post them elsewhere without the estate's permission. Some of it concerns other residents, and some of it is not meant to be public.
The estate's name, logo and the content of this site remain the property of the body corporate.
5. Links to other services
The portal links to systems the estate uses, such as water management, the camera platform and Google Drive. Those links are there for your convenience.
Those services are run by other companies, on their own terms. The estate does not control them and is not responsible for them, for whether they are available, or for anything that happens while you are using them.
6. Suspending or removing an account
The estate may suspend or remove a portal account. The usual reason is simply that somebody has stopped being a resident, but an account may also be suspended if these terms are broken or if there is a security concern.
If your account is removed you lose access to the portal. It does not affect any other right or obligation you have towards the body corporate.
7. Availability and liability
We do our best to keep the site running, but we cannot promise it will always be available, uninterrupted or free of errors. It may be offline for maintenance, or because of something outside our control such as a hosting or network failure.
To the fullest extent the law allows, the body corporate is not liable for any loss or damage arising from your use of this site, from it being unavailable, or from you relying on information on it.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act where it applies. Your rights under South African law stand.
Information on the portal is published in good faith and is kept as accurate as we reasonably can, but it is general estate communication and not professional or legal advice.
8. Privacy
How we handle personal information is set out separately in our Privacy Policy, which is written to meet the Protection of Personal Information Act 4 of 2013 (POPIA). Please read it together with these terms.
9. Changes to these terms
We may update these terms from time to time. The date at the top of this page always shows when they last changed. Continuing to use the site after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the Republic of South Africa, and any dispute arising from them is subject to the jurisdiction of the South African courts.
